1. Not a Medical Device

BrainRank is not a medical device, diagnostic tool, therapeutic device, or healthcare product. The Service has not been evaluated, cleared, approved, or registered by the U.S. Food and Drug Administration (FDA) or any other regulatory body worldwide.

The Service is not intended to:

  • Diagnose, treat, cure, mitigate, or prevent any disease, condition, or disorder.
  • Measure, record, or monitor actual brain activity, neural function, or cognitive state of any individual.
  • Serve as a substitute for professional medical advice, diagnosis, or treatment.
  • Provide clinical, therapeutic, or neuroscientific assessments of any kind.

If you have questions or concerns about your health, brain function, or neurological condition, consult a qualified healthcare professional. Never disregard professional medical advice or delay seeking treatment because of anything you have seen on this Service.

2. AI Predictions Are Computational Estimates

BrainRank uses Meta's TRIBE v2 (Brain-Predictive Foundation Model) to generate neural activation predictions for user-submitted content. It is important that you understand the nature and limitations of these predictions:

  • Computational estimates, not brain scans. The scores, heatmaps, and brain region activations displayed by BrainRank are outputs of a machine learning model. They represent statistical predictions of how populations of brain regions might respond to content, based on patterns learned from functional magnetic resonance imaging (fMRI) training data. They are notrecordings, scans, or measurements of any individual's brain.
  • Probabilistic, not deterministic.AI models are inherently probabilistic. The same content may yield different results under different conditions, and the model's predictions may not correspond to actual viewer responses, engagement, or behavior.
  • Aggregate patterns, not individual predictions. The underlying model was trained on aggregate fMRI data from research participants. Predictions reflect population-level statistical patterns, not the neural response of any specific individual viewer.
  • No causal claims. Higher neural activation scores do not guarantee higher engagement, views, clicks, conversions, revenue, or any other business outcome. Correlation between predicted neural activation and real-world content performance is not established for your specific use case.

3. No Guarantee of Accuracy

We make no warranty, representation, or guarantee, express or implied, regarding the accuracy, reliability, completeness, or usefulness of any analysis results generated by the Service. Specifically:

  • Analysis results may contain errors, inaccuracies, artifacts, or inconsistencies.
  • Scores and metrics may vary based on content format, duration, resolution, language, and other factors.
  • The AI model has known limitations, including a context window of approximately 100 seconds for video content. Content exceeding this duration is analyzed in segments, which may affect overall scores.
  • Model performance may differ significantly across content types (video, image, text), genres, languages, and cultural contexts.
  • Results generated today may differ from results generated for the same content at a later date due to model updates, infrastructure changes, or other technical factors.

4. Content Creator Responsibility

BrainRank is a tool that provides data-informed insights intended to assist content creators in making editorial and creative decisions. However:

  • You are solely responsible for all creative, editorial, and business decisions you make based on or informed by analysis results.
  • BrainRank provides data. The interpretation of that data and any actions taken based on it are entirely your responsibility.
  • We do not guarantee that using the Service will result in increased engagement, views, followers, subscribers, revenue, or any other measure of content performance.
  • Past analysis results do not predict or guarantee future content performance.

5. Research Model Limitations

The TRIBE v2 model used by BrainRank is a research model developed by Meta AI and released under the Creative Commons Attribution-NonCommercial 4.0 International License (CC BY-NC-4.0). You should be aware that:

  • The model was designed for research purposes. Its application to commercial content optimization is an extension of its original intended use.
  • The model's training data consisted of fMRI responses from a limited sample of research participants. The training population may not be representative of your target audience in terms of demographics, culture, language, or other characteristics.
  • The model has an effective context window of approximately 100 seconds for video content. Short-form content (under 100 seconds) is the model's primary sweet spot; longer content is segmented for analysis.
  • As a non-commercial research model, TRIBE v2 has not been independently validated for accuracy in predicting real-world content performance metrics.

6. Third-Party Services

The Service relies on third-party infrastructure to process your content:

  • RunPodprovides the GPU compute infrastructure on which the AI model runs. We are not responsible for RunPod's availability, performance, or security beyond our contractual relationship with them.
  • Supabase provides database, authentication, and file storage services.
  • Stripe processes all payment transactions.

We are not responsible for the acts, omissions, availability, or performance of any third-party service provider. Service interruptions caused by third-party providers are outside our control.

7. Limitation of Liability

To the fullest extent permitted by applicable law, BrainRank shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:

  • Your reliance on any analysis results generated by the Service.
  • Any decisions, actions, or strategies you undertake based on analysis results.
  • Any loss of profits, revenue, data, business opportunities, or goodwill.
  • Any inaccuracies, errors, or omissions in analysis results.
  • Any interruption, suspension, or termination of the Service.

Nothing provided through the Service constitutes professional advice of any kind, including but not limited to medical, legal, financial, investment, marketing, or business advice. The Service is an analytical tool that generates computational predictions. If you require professional advice, consult a qualified professional in the relevant field.
